On Thursday, November 2, 2023, the President of the University of Fallujah, Professor Dr. Sabah Ibrahim Hammadi, attended part of the proceedings of the master’s thesis discussion session in the private law branch of the College of Law, entitled “The Law Applicable to Contracts Related to Intellectual Property.”
The idea of the thesis presented by the student Nour Naji Ibrahim crystallized towards studying the contractual relationship that arises between the one who produces the innovation or composes the work, whether he is an individual author, a worker, or a group of individuals linked by a subscription or Collective authorship and those who exploit and benefit from that intellectual production from behind a business, company, factory, or commercial institution,
as well as studying the contractual relationship that may arise between the owner of the trademark and those who exploit it within the framework of contracts that exceed the territorial scope of a particular country or in which there is a foreign element that takes the contract out of the framework of subjection to internal law to the possibility of laws competing in order to know the applicable law. The Assistant President of the University for Administrative Affairs, Professor Dr. Suleiman Barak Al-Jumaili, chaired the thesis discussion committee, which included For its membership, Professor Dr. Ghassan Obaid Muhammad,
and A.M.D. Nafi Bahr Sultan, and Professor Dr. Ziad Tariq Jassim. The thesis included a statement of the law applicable to contracts related to intellectual property, whether they are contracts related to literary and artistic property, as well as contracts related to industrial and commercial property, through the theories stated by legal jurisprudence, and the position of comparative legislation on them through their objective focus, in accordance with rigid and flexible attribution controls.
