On Thursday, May 30, 2024, the College of Law at Fallujah University discussed A doctoral dissertation in private law entitled “The Philosophy of the Iraqi Legislator in the Field of Personal Status between Reality and Perspective.”
The study presented by researcher Thaer Hamid Awad, under the supervision of Prof. Dr. Adel Nasser Hussein, to highlight the legislative role in the best way by determining.
The method followed when drafting the legal texts of this legislation, defining the legislative objectives stated by the Iraqi legislator, and explaining their suitability to the objectives of Islamic law and the extent to which they achieve legal stability in financial transactions of a family nature before the judiciary.
In addition to diagnosing the shortcomings and defects in the Personal Status Law and providing effective and effective solutions to them.
The thesis discussion committee was chaired by the Undersecretary of the Ministry of Higher Education and Scientific Research for Administrative Affairs Mr. Dr. Adnan Ibrahim Al-Jumaili, and its membership included an elite group of distinguished professors: Prof. Dr. Haider Hussein Kazem, Prof. Dr. Ziad Tariq Jassim, A.M.D. Abdul Rahman Saleh Latif, and Prof. Dr. Khaled Hamad Fayyad.
The results of the study confirmed that one of the priorities of the Personal Status Law is to focus on establishing the basic foundations for building the family from a legal standpoint, and the law’s reliance on Islamic Sharia as a primary source and main source in its legal articles and reference in the event that understanding of the legal text is lost or absent, without absolute reliance on a specific doctrine, but rather referring to the most appropriate legal principles.
